1. One of the largest food retailers in Norway. EY represents the company in a court case against the Tax Authority. The case will be held in February 2023 in Borgarting Appeal Court. The Tax Authority claims that there is no right to deduct input VAT on transaction costs related to the purchase of the shares leading to strengthen the client’s market position. The case is of significant importance and is the first court case in Norway involving VAT deduction of costs related to share purchase with subsequent integration. Ms. Dyrnes is an experienced litigation attorney – and is also admitted to act as an attorney before the Norwegian Supreme Court.
2. EY has in the period 2019-2022 assisted a municipality with the clarification of the VAT handling of the construction of a new metro line. This is the largest metro construction in Norway in modern times. The VAT amounts to 5 billion NOK. EY assisted with the review of alternative models, dialogue with the Tax Authority and the final application for a VAT registration which was accepted in April 2022. The VAT registration involves that the municipality can reclaim the VAT on construction costs.
