During the research period, the team provided counsel to Cosan Lubrificantes e Especialidades in judicial litigation against a BRL 1.3 billion tax enforcement claim of withholding income tax (WIT) with respect to the capital gain attributable to Exxonmobil in the alleged sale of Esso do Brasil, a major distributor of fuel, petrol-products and gas-station operator in Brazil, to Cosan. This is high profile case whose outcome may impact reorganization structures and shed more light on a much controversial but seldom litigated provision for WIT taxation of persons not domiciled in Brazil.
