The tax practice at Deloitte is comprised of 23 tax partners and more than 530 tax professionals. Its practice includes international tax, M&A, private client and indirect taxes. It has a large transfer pricing team with four partners and 90 dedicated transfer pricing professionals. It offers various indirect tax services, including GST, SST, customs dispute resolutions, audit and tax planning. The team is active in the financial services, oil and gas and real estate sectors. The team also focuses on Chinese and Korean clients and has set up a Chinese group and Korean group, led by Tham Lih Jiun and Chee Pei Pei respectively.

The team is one of the largest teams in Malaysia, comprises of approximately 700 employees in 15 offices, including professionals with strong backgrounds in accounting, tax, law and business economics and former senior government officials. It supports a full range of tax services such as cross border tax advisory, global compliance and reporting, indirect tax, transfer pricing and transaction tax, just to name a few.

KPMG

The team has approximately 300 tax professionals and offers services including corporate tax services, global mobility services, tax dispute resolution, transfer pricing and indirect taxes. The corporate tax is led by Tai Lai Kok and covers tax compliance and advisory services. It specialises in advising clients on the areas of inbound and outbound investments, mergers and acquisitions, international tax advice, tax due diligence and tax diagnostic review.

Soh Lian Seng led the team and assisted the client in presenting its appeal to the IRB on the tax dispute. The work includes liaising, discussing and strategizing with the client and its appointed legal counsel on the income tax issues under tax dispute, and discussing with the IRB on the client’s proposed settlement.

Rosli Dahlan Saravana Partnership

Partner S Saravana Kumar is the head of the tax practice. He is specialised in tax litigation and transfer pricing practices. The team supports a wide range of tax services, including sales and service tax, customs duty, transfer pricing, double taxation treaties, permanent establishments, real property gains tax, petroleum income tax and stamp duty. It is experienced in representing clients in cases before the Special Commissioners of Income Tax, High Court, Court of Appeal and the Federal Court. It also represents clients in various trade actions or investigations in respect of anti-dumping, safeguard duties, countervailing duties, anti-circumvention, free trade agreements and cross-border transactions.

The team recently acted as a counsel for a Malaysian multinational electricity company. In this matter, the Inland Revenue Board Malaysia (IRBM) took the position that the client was not entitled to claim reinvestment allowance. The team successfully obtained leave to commence judicial review, also an order to stay the IRBM’s Decision pending the substantive stage of the judicial review application.

Shearn Delamore & Co

The tax and revenue practice group is experienced and specialised in tax litigation audit and investigation practices. It continues to receive substantial referral work, including transfer pricing dispute resolution work, from all the large tax accounting practices in the country. Key partners include Anand Raj, who covers tax disputes, Irene Yong and Foong Pui Chi cover tax advisory and tax litigation.

The team recently acted for the client in an appeal before the Court of Appeal following the decision of the High Court to deny the taxpayer leave to apply for Judicial Review following certain transfer pricing adjustments made by the Revenue.

Key partner Goh Ka Im retired and left the team at the end of 2020.

Skrine

The tax and revenue practice is led by Preetha Pillai and the team provides diverse revenue solutions to address client’s tax objectives. It advises on and represent clients in court and before the relevant tribunals on matters related to corporate tax, sales and service tax, real property gains tax, employment tax, stamp duty, customs duties and excise, anti-dumping and safeguards, and rates and assessments. It also supports services of navigating tax audits and investigations.
