Fabara & Compania

Founded in 2013, Fabara & Compañía Abogados comprises the legal practice together with the accounting and financial practice. María Rosa Fabara Vera is the leader of the tax department focussed on tax consulting, tax planning, tax structuring and M&A transactions. The firm is also very active in tax audits and compliance. 

This year the team has worked on different tax matters with an emphasis on customs. For example, it successfully advised Abbot Laboratorios del Ecuador on a customs matter. Other clients included China Hidroelectricidad Ingeniería Consultorio Grupo, Icesa, Intertek International and Construmercado.  

Over the research period, the tax department welcomed junior partner Sofía Gordillo hired from Andersen Tax & Legal. The firm lost junior partner Yael Fierro Guillén who went to work to the internal revenue service.

Its biggest strengths in Ecuador are its tax corporate and transactional work advising on M&A transactions, company reorganisation and financial structuring. Over the research period, the tax department worked on different complex and numerous tax matters advising domestic and international companies. The group advised Iberopesca on different tax audits and on Constitutional court procedures and judicial procedures against the Ecuadorian Internal Revenue Service. Another interesting mandate saw the tax team representing MMR in Ecuador on several refunds, income tax audits and other tax issues. The group also represented Cargolux on obtaining VAT refunds.  

Perez Bustamante & Ponce

A leading firm in Ecuador, Pérez Bustamante & Ponce excels in different tax practice areas. The team is very large and is comprised of 18 lawyers and 23 professional tax advisors, including accountants and engineers. The heads of the tax department are Juan Gabriel Reyes and Maria Rosa Guerra. The team advises domestic and international companies on tax planning, tax structuring, cross-border M&A transactions and project financing. The firm is also very active in transfer pricing. The group is specialised in different sectors, including banking, mining, oil and gas, construction, technology and real estate. 

Over the research period, the tax team worked on an impressive number of matters. For example, it represented the technology company Cabify on the discussion with local tax authorities to operate in Ecuador. The group advised World Posorja on the long-term implications of the financing structure for the construction of the Posorja port. It also represented Columbia Forest on tax and corporate matters.

Vivanco & Vivanco

Vivanco & Vivanco offers a regional understanding of Latin America applied to Ecuador. The firm, headquartered in Miami, is located in Panama, Argentina, Venezuela, Costa Rica, Colombia and it has two offices in Ecuador, in addition to a London branch.  

The department based in Quito and Guayaquil provides services related to companies that want to expand their business in Ecuador. Key contacts at the firm are CEOs and partners Clemente Vivanco and Guillermo Camacho. Gerardo Aguirre is the chairman and partner.

Over the research period, the firm was active in corporate tax and tax structuring in different sectors, including technology and real estate. For example, the team advised the construction company GLS on a process started by the SRI, the Ecuadorian Tax Office. Other clients were TvCable and Fideicomiso Hotel Proyecto Cuenca. 

The firm hired senior associate Juan Pablo Borja Durini from Microsoft and lost associate Juan Sebastian Flor who went to work to the presidency of Ecuador.
