In response to the recent tax reforms, including the elimination of broad tax incentives for foreign investors, White & Case's tax attorneys have been busy assisting clients in rethinking their traditional China tax planning strategies, as well as evaluating areas of risk and how to minimise such risks.

In the year since becoming head of China tax, Peter Ni has been involved in some of the firm's major transactions. With Jiang Bian, he advised a leading Chinese bank in its acquisition of a European bank. The structuring involved a number of key Chinese tax issues such as controlled foreign corporations (CFCs), treaty shopping, indirect foreign tax credit, and thin capitalisation. It also required innovative solutions to comply with European anti-avoidance rules.

In a year since joining White & Case, Linda Ng has built a solid reputation as a leading tax counsel in Hong Kong. Ng advised a leading Asian investment bank on Hong Kong tax issues regarding various onshore and offshore structures for investing in real property in mainland China and also advised on tax issues related to the proposed spin-off and sale of global lines of business of one of the world's largest multinational conglomerates.

Like other law firms, White & Case uses its Hong Kong offices to act as a gateway for investors into China and the firm regularly creates tax-efficient structures and tax-advantaged vehicles for multinationals looking to take advantage of Chinese markets.

White & Case has been involved in some of the country's largest transactions, despite its size when compared to the much larger accountancy firms. It advised European investment banks on issues connected with their derivatives and securities businesses, assisted leading international fund groups with their investments into Japan and guided major foreign and Japanese multinational companies with regard to the Japan and international tax aspects of mergers and acquisitions, corporate reorganisations and real property investments in Japan and globally.

Michael Shikuma was promoted to partner in January 2009. He specialises in the taxation of cross-border M&A, leasing transactions and investment funds, as well as international estate planning in the US, Japan and the Asia-Pacific region, and has extensive US federal and state income, sales and transfer tax experience, including experience in representing multinational corporate and individual clients in tax controversy cases.

Transfer pricing specialist, Gary Thomas has been described by peers as the "authority" for transfer pricing in Japan and one client described him as the "leading guy when something blows up" in Japanese transfer pricing.

Eric Roose and Linda Ng worked together on a complex joint-venture between Iconix Brand Group and Novel Fashion Holdings. The transaction involved a complicated series of intellectual property assignments and licences and corporate arrangements that were all carefully scrutinised for tax purposes by the NTA.
