ATOZ - Taxand offers expertise across all areas of tax with a particular focus on international corporate tax work. The group has continued to grow this year and comprises 64 fee earners. Keith O'Donnell heads the practice and is praised for his work in the real-estate and private-equity sectors. Both Christophe Plainchamp and Jamal Afakir stepped up to partnership.
The firm advise financial institutions and blue-chip companies, especially US, on cross-border matters. O'Donnell and David Cordova advised Heitman, a real estate investment firm, on the acquisition of a group of companies holding real estate in Moscow. The structure they proposed overcame Russia's real estate rules on the location of bank debt. In implementing a new structure the two were able to trigger the deduction of interest from the related income.
The group helped LaSalle Investment Management overcome a trapped cash problem regarding a booked depreciation asset by use of an innovative hybrid instrument, an asset-linked equity certificate. Partner Oliver Remacle represented Compagnie de Banque Privée in their merger with the private banking business of Quilvest. This was one of the largest deals this year involving Luxembourg companies.
ATOZ-Taxand has also launched a new transfer pricing group this year led by Jean-Michel Chamonard. This follows Circular 164/2, which was issued by the authorities to bring advance pricing agreements for financial companies more in line with the OECD model. The firm is representing a group of leading US investment funds in their dispute with a number of authorities concerning an excess of withholding tax levied in the EU.
