Kojima Law is part of Taxand's global network. Tax leader Eiki Kawakami provides tax planning and compliance services to overseas investors on their real estate investments in Japan.
Considering the transaction to be a trial for future investments, one client invested directly and indirectly through an intermediary company. Kawakami analysed the pros and cons for each structure.
Despite the real estate seller's argument that the consumption tax charged on the investments would not be refundable, Kawakami proved that this interpretation of the tax regulations was incorrect and the client successfully received their money back for the VAT charged on the acquisition.
