A significant entrant to the French legal market is McDermott Will & Emery. The firm opened its office in Paris in May and launched a tax practice shortly afterwards withone partner, Hervé Bidaud, formerly of Hogan & Hartson and TruePartners Consulting, one of counsel and one associate. Given the strong showing of the firm in tax internationally, its French practice can be expected to make rapid headway.

McDermott Will & Emery's tax practice is led by Dirk Pohl who is frequently mentioned by his peers as a leading practitioner in Germany, especially in the field of tax controversy. He is one of three partners and leads a team of eight.

This year he and fellow partner Gero Burwitz advised a multinational pharmaceutical group in an appeal at the Federal Finance Court regarding VAT issues. Pohl also advised another client in the finance court in a matter concerning the implications of the German Reorganisation Tax Act.

The practice also provides general business tax advisory services. This year partner Peter Bauschatz advised OctreoPharm Sciences on the structuring of a first round of financing. Other work includes advising on a joint venture between a Polish subsidiary and a Dutch strategic partner.

McDermott Will & Emery's tax team offer services across all areas of tax. Carlo Paolella leads a team of seven. The bulk of the practice's work is split between corporate and tax disputes.

This year the group advised a large US-based Italian multinational on a series of acquisitions as part of their expansion into Latin America.

The firm represented a US multinational on a permanent establishment issue where the Italian authorities were pressing for $600 million in penalties. The matter worked out well the client as the tax paid in Italy was fully credited at the level of the parent company.

The group has expanded its client base this year to include Aon, Brooks Brothers, Barilla, BNP Paribas Lease Group, Amadeus Capital Partners and Manpower.

The tax department of McDermott Will & Emery is led by the transfer pricing specialist Peter Nias and comprises four partners, one associate and a recently added a tax director from one of the big four accounting firms. The firm is capable in a range of tax matters including corporate support and M&A work, but focuses on tax planning, structuring and restructuring. Two of the practice's partners focus on various international tax and cross border structuring issues and Nias is chairman of the International Tax Sub-Committee of the Law Society's Tax Law Committee.
